Court of Appeal upholds preliminary objection, dismisses writ of quo warranto against Prime Minister Ranil Wickremesinghe

Court of Appeal has dismissed the writ of quo warranto against Premier Ranil Wickremasinghe that challenged his being a Parliamentarian. Court upheld a preliminary objection raised by Counsel.

The petition was filed by the Chair of Women's Organization for Justice Shamila Gonawala, a Colombo Municipal Council member of the Sri Lanka Podujana Peramuna (SLPP).

During the hearing of the petition, President's Counsel K. Kanag Iswaran representing the Prime Minister Ranil Wickremesinghe, raised a preliminary objection that the Court of Appeal had no jurisdiction to hear the petition since the original copies of the documents cited as evidence in the case have not been submitted to the court. According to the Supreme Court Order No. 3, when filing a petition, it is necessary to submit the original documents or certified documents to prove it. Therefore, the court ought to reject the petition without considering.

The Bench comprised of Justices Shiran Gunaratne and Priyantha Fernando.
